A proposal to allow for topless sunbathing in Asbury Park has been scrapped. The City Council there has made the decision to turn down an ordinance that would allow for a small section of beach to become topless. A legal opinion told council that there is case law showing that it would be breaking laws on the books about nudity. Only a couple of places, like Sandy Hook, offer topless sunbathing spots.
