The man accused of striking and killing two teenage cousins on Bayshore Road last July was in court on Monday, seeking to have the indictments against him dropped. Brian Pelloni, lawyer for the accused driver Joshua Malmgren, made a motion to dismiss the charges of aggravated manslaughter dropped, but the motion was denied. A second motion to move the trial out of Cape May County was also denied by the judge. Malmgren is free on bail and has pleaded not guilty to the charges.
