A wrongful death suit will move forward involving the woman killed over Polar Bear Plunge weekend in 2009. Tracy Hottenstein’s body was found on Feb. 14 by a local fisherman. She had been drinking the night before and fell off a dock around 2:15 a.m. She was pronounced dead when she was found and the judge said its not clear she was in fact dead at the moment she was found. Because of the pronouncement of death, first aid response couldn’t access the body.
